These Terms of Service (“Terms”) govern your access to and use of ecadcam.com (the “Site”) and the services provided by eCadCam Inc (“eCadCam,” “we,” “us,” or “our”), including 3D printing, 3D scanning, CAD design, laser cutting, laser engraving, and related services (the “Services”). By using the Site or engaging our Services, you agree to these Terms.
Our Services
eCadCam provides custom manufacturing and design services based on the specifications and files you provide. Descriptions of materials, technologies, and turnaround times on the Site are provided for general information and may vary by project.
Quotes and Orders
Quotes are estimates based on the information and files you submit and are valid for the period stated. A project is confirmed only when we accept your order and agree on scope, price, and timing. We reserve the right to decline any project at our discretion.
Customer Files and Intellectual Property
You retain all ownership of the designs, models, and files you submit. By submitting files, you represent and warrant that you own them or have all rights necessary to have the items produced, and that producing them does not infringe any third party’s intellectual property or other rights. We do not claim ownership of your designs and use them only to provide the Services you request.
Confidentiality
We treat the files and project information you provide as confidential and do not disclose them to unrelated third parties except as needed to deliver the Services or as required by law.
Prohibited Items
You may not use our Services to produce items that are illegal, that infringe intellectual property rights, or that include functional weapons or weapon components, or any item prohibited by applicable law. We reserve the right to refuse any request that we believe violates these Terms or applicable law.
Payment
Payment terms are specified in your quote or invoice. Unless otherwise agreed in writing, payment is due as stated on the invoice. Work may not begin or items may not be released until payment terms are met.
Turnaround and Delivery
We make every effort to meet stated turnaround times, but delivery dates are estimates and are not guaranteed. We are not liable for delays caused by factors beyond our reasonable control, including issues with submitted files, materials availability, or shipping carriers.
Warranties and Disclaimers
We strive to deliver high-quality results that meet the specifications you provide. Except as expressly stated, the Services and Site are provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose. You are responsible for ensuring that your designs and specifications are correct and suitable for your intended use.
Limitation of Liability
To the fullest extent permitted by law, eCadCam will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, arising out of or related to the Services or the Site. Our total liability for any claim relating to a project will not exceed the amount you paid for that project.
Indemnification
You agree to indemnify and hold eCadCam harmless from any claims, damages, or expenses arising from your designs or files, your use of the Services, or your violation of these Terms or any law or third-party rights.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes will be subject to the jurisdiction of the state and federal courts located in California.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
